Este libro desarrolla aspectos epistemológicos de la prueba penal en la búsqueda de la verdad. A efectos de demostrar aseveraciones sobre hechos, se analizan los conflictos que surgen con el derecho probatorio. Se estudia la valoración de la prueba y la aplicación de las reglas de la lógica, la importancia de la probabilidad inductiva, además de otros enfoques como la lógica difusa o polivalente. Se aborda, además, el estándar de prueba, como la regla que fija el grado de suficiencia de pruebas que se requiere para demostrar las hipótesis fácticas.

El proceso penal es, en efecto, un fenómeno complejo, para cuyo conocimiento no basta una actividad meramente exegética, ni teoricamente abstracta. También se requiere una sensibilidad hacia sus perfiles valorativos y pragmáticos, atento los elementos gnoseológicos, psicológicos y sociales que inevitablemente condicionan el curso de los procedimientos. En otras palabras, cada una de las disposiciones procesales penales debe ser interpretada, no solo en relación al sistema jurídico, sino también en relación a las razones subyacentes que las inspiran.
